Terms of Service
Last updated 16 October 2026
Draft for legal review. Highlighted notes mark points a lawyer must confirm; they disappear once review is complete.
These terms apply when you use Whisker & Oil and when you buy a portrait. They are written for consumers. Nothing in them takes away rights you have under the consumer law of the country where you live.
About us
Whisker & Oil is operated by [Company legal name] Limited, registered in Ireland under company number [CRO number], [Registered office address], Ireland. VAT number [Irish VAT number]. Email: hello@[domain]. We aim to answer within two working days.
What we offer
You upload a photo of your pet and choose a style. We generate a watermarked preview for free. If you buy, you get the full-resolution digital file(s):
- Single Portrait: One high-resolution portrait in the style you choose. $12.99 / €12.99 / £10.99.
- The Collection: Every style, all in high resolution. Plus a print-ready file. $24.99 / €24.99 / £19.99.
Prices in euro and pounds include VAT. US prices exclude any sales tax, which is added at checkout where it applies. These are digital products only; nothing is posted to you.
Portraits are created by an AI image model. Each one is unique, and results vary: the model interprets your photo, so small details such as markings, background or pose may differ from the original. That is why you see a preview before paying, and why we offer a redo or refund.
Ordering and payment
Payment is handled by Stripe, which acts as the reseller and merchant of record for your purchase: your card statement shows Stripe's descriptor, and Stripe issues the receipt and handles tax. Your contract for the portrait itself is with us, and we are responsible for delivering it and for these terms.
Legal review: Confirm how Stripe Managed Payments frames the contract (reseller vs. our sale) and align this paragraph and the order confirmation with Stripe's required end-customer terms. The contract is formed when payment succeeds and we show the confirmation page. We send a confirmation email with your order details and download link.
Delivery
Your files are available to download immediately after payment, on the confirmation page and by email. The download link stays valid for 30 days; after that we delete the files, so please save them. If a download fails, contact us and we will send a new link.
Right of withdrawal (EU and UK customers)
If you live in the EU or UK you normally have 14 days to withdraw from an online purchase. For digital content supplied immediately, that right ends once delivery starts, but only if you asked for immediate delivery and acknowledged that you would lose the right. We ask for both at checkout and confirm them in your order email. Details and the model withdrawal form are on Right of withdrawal.
Independently of that, our redo-or-refund promise applies for 30 days to every order, wherever you live.
Your photos
Only upload photos you took or have permission to use. Do not upload photos of people, illegal content, or anything you do not have the right to share. We may refuse or remove photos that break these rules, and the AI provider may refuse some photos automatically.
You keep all rights in your photo. You give us permission to use it only to make your previews and portraits and to provide the service. We delete uploads after 30 days. We will not use your photo or portraits in advertising unless you separately and explicitly agree.
Using your portrait
Once you have paid, you may use your portrait for any personal, non-commercial purpose: print it, frame it, share it online, give it as a gift. You may not resell the files or use them to sell products without our written permission. Unpaid previews carry a watermark and may only be viewed, not copied or reproduced.
Legal review: Under Irish and EU law, purely AI-generated images may not attract copyright. Confirm whether to frame this as a licence (as above) or as an assignment of whatever rights we hold, and check the image provider's output terms.Style names describe general art movements and themes. Portraits are not affiliated with or endorsed by any artist, studio or brand.
Fair use
Free previews are limited per visit. Please do not use automated tools, multiple accounts or other ways around these limits; we may block access if you do.
Our responsibility to you
We provide the service with reasonable care and skill, and your portrait will match what we describe. If it does not, you are entitled to have it put right (a redo) or, if that is not possible, a refund, as required by consumer law and as set out in our refunds and redo policy.
We are not responsible for losses that were not foreseeable, for business losses, or for delays caused by events outside our control. Our total liability for any order is limited to the price you paid for it. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law.
Legal review: Check the liability clause for enforceability against consumers in IE, UK and US states.Complaints and disputes
Please email hello@[domain] first; most problems can be solved with a redo or refund. These terms are governed by Irish law, and you can bring a claim in the courts of Ireland or the courts of the country where you live. If you live in the EU or UK, you keep the protection of the mandatory consumer law of your country.
Legal review: The EU online dispute resolution (ODR) platform closed in July 2025, so no ODR link is given. Confirm whether to name an alternative dispute resolution body.Changes
We may update these terms. The version that applies to your order is the one on the site when you placed it.
